Latest on the Flood and Water Management Act 2010

Private sewers and lateral drains in Wales and England which were laid as at 01 July 2011 transferred to the sewerage Undertakers (water companies) on 1 October 2011.

The Welsh Government has announced that Section 42 of the Flood and Water Management act 2010 will be implemented on 1 October 2012. After which, all new sewers and lateral drains connecting to a public sewer will be adopted by the sewerage undertakers that are wholly or mainly in Wales (i.e. those within the Dŵr Cymru Welsh Water operating area). Adoption is expected to occur on occupation of the home, although final confirmation of that is awaited.

In addition the Welsh Government has published 'Draft Standards for new gravity foul sewers and lateral drains' and 'Guidance on the mandatory adoption of sewers and lateral drains and on the Welsh Ministers' Standards for gravity foul sewers and lateral drains'. They can be found here:

The introduction of this new process, in Wales, will trigger another transfer of private sewers and lateral drains connected to the public system between 1 July 2011 and 1 October 2012. This will happen on 1 April 2013.

The changes include a 12 month transitional period in which development with prior approval from the Local Authority or for which an appropriate notice has been submitted can commence as planned without the need to comply without the new requirement for standards, if work has started by 01 October 2013.

The date for the equivalent adoption of new sewers and lateral drains in England is still awaited to be announced by DEFRA.

NHBC is continuing to assist Lloyds Register in the development of the Sewerage Infrastructure Registration scheme (SIRS).
